1. ACCEPTANCE OF TERMS
Welcome to The Recovery Den. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Member,” “Guest,” “you,” or “your”) and The Recovery Den (“we,” “us,” or “our”) governing your use of our facilities, services, and website.
By booking a session, purchasing a membership, or entering our facility, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our:
- Privacy Policy
- Liability Waiver and Release
- Etiquette Guidelines (available at recoveryden.ca/recovery-den-etiquette/)
If you do not agree to these Terms, you may not use our services or access our facility.
2. FACILITY OVERVIEW
The Recovery Den is a private recovery facility located at:
14 Garrard Rd, Unit 4, Whitby, ON L1N 3K3
Operating Hours:
Tuesday through Sunday: 5:00 AM – 10:00 PM
Closed Mondays
2.1 Services Offered
We provide the following recovery therapies:
- Infrared Sauna Therapy
- Cold Plunge Therapy
- Compression Therapy (coming soon)
2.2 Exclusive Access Model
The Recovery Den operates on an exclusive booking system:
- Each booking reserves the entire facility for your scheduled time block
- Only you and your registered guests will have access during your session
- No other members or guests will be present in the facility during your booking
- This ensures maximum privacy, comfort, and an uninterrupted recovery experience
3. ELIGIBILITY AND ACCOUNT REGISTRATION
3.1 Age Requirements
To use The Recovery Den services, you must meet the following age requirements:
Sauna Therapy:
- Minimum age: 16 years old
- Ages 16-17 must be accompanied by a parent or legal guardian at all times
Cold Plunge Therapy:
- Minimum age: 12 years old with supervision
- Ages 12-15 must be supervised by a responsible person aged 16 or older who remains in the facility during the entire session
- Ages 16-17 may use the cold plunge independently or with guardian consent
Compression Therapy:
- Minimum age: 16 years old
- Ages 16-17 must be accompanied by a parent or legal guardian
3.2 Account Creation
To book sessions or purchase memberships, you must:
- Provide accurate, complete, and current information
- Maintain the confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
3.3 Parental/Guardian Consent
If you are under 18 years of age, your parent or legal guardian must:
- Complete and sign the Liability Waiver on your behalf
- Accept full responsibility for your conduct and safety
- Provide supervision as required by age restrictions
4. MEMBERSHIPS AND PACKAGES
The Recovery Den offers various membership tiers and drop-in packages to suit different recovery needs and schedules. Current pricing, package details, and membership options are available:

4.1 Membership Terms
Billing and Payments:
- Membership fees are charged automatically on a monthly basis to the payment method on file
- You are responsible for ensuring your payment information is current and valid
- Failed payments may result in suspension of access until payment is received
Minimum Commitments:
- Some membership tiers may require minimum commitment periods
- Early cancellation of memberships with minimum commitments may result in payment of the remaining balance for the commitment period
- Specific commitment terms will be disclosed at the time of purchase
Membership Modifications:
- You may upgrade your membership at any time; the new rate applies in the next billing cycle
- Downgrades may be subject to restrictions based on commitment terms
Session Rollovers:
- Session rollover policies vary by membership tier
- Specific rollover terms will be disclosed at the time of purchase
Guest Privileges:
- Some memberships include guest passes
- Guest passes included in memberships are non-transferable and expire at the end of the billing period
- Guests must complete a Liability Waiver before participating
4.2 Package Terms
Expiration:
- Prepaid session packages have expiration dates specified at the time of purchase
- Unused sessions after expiration are forfeited without refund
Transferability:
- Packages are non-transferable and may only be used by the purchaser
- Guests may join sessions as specified in package terms
5. BOOKING, CANCELLATION, AND NO-SHOW POLICY
5.1 Booking Sessions
- Sessions must be booked in advance through our online booking system, phone, or email
- Bookings are subject to availability
- We reserve the right to limit booking frequency to ensure fair access for all members
5.2 Cancellation Policy
Free Cancellation:
- You may cancel or reschedule a booking more than 6 hours before your scheduled session time without penalty
Late Cancellation Fee: $10
- Charged if you cancel or reschedule within 6 hours of your scheduled session time
- Fee applies per session
No-Show Fee: $20
- Charged if you fail to attend a scheduled session without prior cancellation
- Fee applies per session
5.3 Payment of Fees
- Cancellation and no-show fees will be charged to the payment method on file
- Fees must be paid before future bookings can be made
- Repeated violations (3 or more no-shows or late cancellations within a 30-day period) may result in:
- Suspension of booking privileges
- Termination of membership without refund
5.4 Facility Cancellations
If The Recovery Den must cancel your session due to:
- Equipment malfunction or maintenance
- Facility emergency or closure
- Circumstances beyond our control
You will receive:
- Full credit for the session to be used at a future date, OR
- Full refund if you prefer (for paid sessions only)
We will make reasonable efforts to notify you as soon as possible of any cancellations.
6. REFUND POLICY
6.1 Membership Refunds
- No refunds are provided for monthly membership fees once charged
- If you cancel a membership with a minimum commitment before the commitment period ends, you are responsible for the remaining balance
- Exception: Refunds may be granted at our sole discretion for documented medical reasons that prevent you from using the facility
6.2 Package Refunds
- No refunds are provided for unused sessions in purchased packages
- Packages are valid for the specified timeframe and expire as stated
- Exception: Refunds may be granted at our sole discretion for documented medical emergencies
6.3 Processing Refunds
Approved refunds will be processed within 14 business days to the original payment method.
7. FACILITY RULES AND CODE OF CONDUCT
7.1 Health and Safety Requirements
By entering The Recovery Den, you certify that:
- You have completed and signed the Liability Waiver and Release
- You are not infected with any communicable disease and do not have open sores or wounds
- You have disclosed any relevant medical conditions or health concerns
- You understand and accept the risks associated with sauna, cold plunge, and compression therapies
7.2 Prohibited Conduct
The following behaviors are strictly prohibited and may result in immediate removal, membership termination, and/or additional fees:
Health and Hygiene Violations:
- Entering the facility with a communicable disease or active infection
- Using therapies with open sores, wounds, or skin infections
- Nudity in any area of the facility – appropriate attire must be worn at all times for hygiene and sanitary reasons
- Failing to shower before using the cold plunge
- Polluting the water in the cold plunge (spitting, spouting water, blowing nose, urinating, or defecating)
Safety Violations:
- Bringing glass containers into therapy areas
- Using therapies while under the influence of alcohol or recreational drugs
- Ignoring posted safety guidelines or staff instructions
- Exceeding recommended time limits or temperature settings
Behavioral Violations:
- Disruptive, threatening, or abusive behavior toward staff or other guests
- Recording, photographing, or filming without express written consent
- Unauthorized access to restricted areas
- Theft, vandalism, or damage to property
- Misuse of equipment or facilities
7.3 Facility Abuse and Cleaning Fees
Minimum Cleaning Fee: $150
You will be charged a minimum cleaning fee of $150 if you:
- Pollute or contaminate the cold plunge water (including but not limited to bodily fluids, food, beverages, or any foreign substances)
- Leave the facility in an excessively unsanitary condition requiring deep cleaning or sanitization beyond normal turnover procedures
- Cause damage to equipment, surfaces, or furnishings requiring specialized cleaning or repair
- Violate hygiene standards in a manner that renders the facility temporarily unusable for the next scheduled guest
Additional charges may apply if:
- Cleaning or repairs exceed the scope of the minimum fee
- Water replacement or chemical rebalancing is required for the cold plunge
- Professional cleaning or restoration services are necessary
- Equipment replacement is required
The cleaning fee will be charged to the payment method on file. Repeated violations may result in permanent termination of membership without refund.
7.4 Proper Attire
For Sauna:
- Clean swimwear, athletic shorts, moisture-wicking clothing, or breathable attire
- Must sit or lie on a clean towel
- Nudity is prohibited for hygiene and sanitary purposes
For Cold Plunge:
- Clean swimwear or athletic attire
- Nudity is prohibited for hygiene and sanitary purposes
For Compression Therapy:
- Comfortable, form-fitting athletic clothing as directed by staff
For Common Areas:
- Robes, athletic wear, or casual attire
- Clean indoor footwear or bare feet in designated zones (no street shoes in therapy areas)
7.5 Etiquette Guidelines

Key expectations include:
- Respect the quiet, relaxing atmosphere
- Keep voices low and minimize disruptions
- Arrive on time for your booking
- Leave the facility clean and tidy for the next guest
- Report any equipment issues or concerns to staff immediately
8. VIDEO SURVEILLANCE AND PRIVACY
8.1 Surveillance Notice
For the safety and security of all guests and staff, video surveillance cameras are installed in the following areas:
- Main entrance and reception
- Common hallways and corridors
- Exterior access points
8.2 Private Areas (NOT Monitored)
The following areas are completely private and NOT monitored by video:
- Changing rooms and restrooms
8.3 Recording Prohibition
You are strictly prohibited from recording, photographing, or filming:
- Other guests or staff members
- Any part of the facility (interior or exterior) without express written consent
Violations will result in immediate termination of your session and membership without refund, and may result in legal action.
8.4 Privacy Commitment
Video footage is:
- Securely stored and accessible only to authorized management
- Retained for 30 days unless required for investigation or legal purposes
- Used solely for security, safety, and incident resolution
- Never shared publicly or used for marketing without consent

9. LIMITATION OF LIABILITY
9.1 Assumption of Risk
You acknowledge that sauna therapy, cold plunge therapy, and compression therapy involve inherent risks, including but not limited to:
- Dehydration, dizziness, fainting, injury, or in rare cases, death
- Aggravation of pre-existing medical conditions
- Slips, falls, or other accidents
By using our services, you voluntarily assume all risks associated with participation.
9.2 Waiver and Release
By agreeing to these Terms, you reaffirm the waiver and release provisions in the Liability Waiver and Release document, which include:
- Waiving your right to sue The Recovery Den for injuries or damages arising from use of the facility
- Releasing The Recovery Den, its owners, employees, and affiliates from all liability
- Indemnifying The Recovery Den against claims, costs, or expenses arising from your conduct or use of services
9.3 Limitation of Damages
To the maximum extent permitted by law:
- The Recovery Den shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the facility or services
- Our total liability to you for any claim shall not exceed the amount you paid for the service in question
9.4 Property Damage and Loss
- The Recovery Den is not responsible for lost, stolen, or damaged personal property
- Lockers and storage areas are provided for convenience but are not monitored
- You are responsible for securing your valuables
10. TERMINATION AND SUSPENSION
10.1 Termination by Member
You may terminate your membership at any time by providing written notice via email or in person, subject to:
- Minimum commitment obligations (if applicable to your membership tier)
- No refunds for unused sessions or prepaid fees
10.2 Termination by The Recovery Den
We reserve the right to suspend or terminate your membership immediately and without refund if:
- You violate these Terms of Service, the Liability Waiver, or Etiquette Guidelines
- You engage in prohibited conduct or unsafe behavior
- You have repeated no-shows or late cancellations
- You fail to pay outstanding fees or charges (including cleaning fees)
- You provide false or misleading information
- You pose a health or safety risk to yourself, staff, or other guests
- You repeatedly leave the facility in unsanitary condition or abuse the facilities
10.3 Effect of Termination
Upon termination:
- Your access to the facility will be immediately revoked
- Any outstanding fees or charges (including cleaning fees) remain due and payable
- Unused sessions or membership credits are forfeited without refund
- You must return any facility property (e.g., access cards, towels) in your possession
11. INTELLECTUAL PROPERTY
11.1 Ownership
All content on The Recovery Den website and within the facility, including but not limited to:
- Logos, trademarks, service marks, and brand names
- Text, images, graphics, videos, and design elements
- Facility layouts, equipment configurations, and proprietary methods
are the exclusive property of The Recovery Den and are protected by copyright, trademark, and other intellectual property laws.
11.2 Prohibited Use
You may not:
- Reproduce, distribute, modify, or publicly display our content without written permission
- Use our trademarks, logos, or branding in any manner
- Reverse engineer or copy our facility designs or recovery protocols
11.3 User-Generated Content
If you provide testimonials, reviews, or feedback:
- You grant The Recovery Den a non-exclusive, royalty-free, perpetual license to use, reproduce, and display your content for marketing purposes
- You represent that you have the right to grant this license
- You may request removal of your content at any time by contacting us
12. THIRD-PARTY SERVICES
The Recovery Den may integrate third-party services such as:
- Payment processors (e.g., Stripe, Square)
- Booking and scheduling platforms
- Email marketing services
We are not responsible for:
- The performance, security, or privacy practices of third-party services
- Any issues arising from your use of third-party platforms
- Interruptions or errors caused by third-party service providers
Please review the terms and privacy policies of any third-party services you interact with.
13. FORCE MAJEURE
The Recovery Den shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters (floods, fires, earthquakes, severe weather)
- Pandemics, epidemics, or public health emergencies
- Government orders, lockdowns, or legal restrictions
- Equipment failures, power outages, or utility disruptions
- Labor disputes or supply chain issues
In such events, we will make reasonable efforts to notify affected members and provide alternative arrangements when possible.
14. DISPUTE RESOLUTION

14.2 Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
14.3 Jurisdiction
Any legal disputes arising from these Terms or your use of The Recovery Den shall be resolved exclusively in the courts of Ontario.
14.4 Waiver of Class Actions
You agree to resolve disputes individually and waive your right to participate in class action lawsuits or class-wide arbitration.
15. MODIFICATIONS TO TERMS
15.1 Right to Modify
The Recovery Den reserves the right to modify these Terms of Service at any time. Changes may be made to:
- Reflect changes in our services, pricing, or policies
- Comply with legal or regulatory requirements
- Improve clarity or address operational needs
15.2 Notice of Changes
When we make significant changes:
- We will update the “Last Updated” date at the top of these Terms
- We will notify you via email (if provided) or through a notice on our website
- For material changes affecting your rights, we will provide at least 30 days’ notice
15.3 Acceptance of Changes
Continued use of our services after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the changes, you must discontinue use of our services and may cancel your membership.
16. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction:
- That provision shall be modified to the minimum extent necessary to make it valid and enforceable, OR
- If modification is not possible, the provision shall be severed from these Terms
All other provisions shall remain in full force and effect.
17. ENTIRE AGREEMENT
These Terms of Service, together with our:
constitute the entire agreement between you and The Recovery Den regarding your use of our services and supersede any prior agreements, understandings, or representations.

19. ACKNOWLEDGMENT
By booking a session, purchasing a membership, or entering The Recovery Den facility, you acknowledge that:
- You have read and understood these Terms of Service in their entirety
- You have had the opportunity to ask questions and seek clarification
- You agree to be legally bound by these Terms
- You understand that violation of these Terms may result in termination of your membership, cleaning fees, and legal consequences
